In this privacy statement, we explain what types of personal data we collect and process and the purposes for which we do so. We recommend that you read this statement carefully.

It is of the utmost importance to Machine Fabriek Elburg B.V. that personal data are handled with due care. We therefore process and secure personal data with the utmost care and attention. In doing so, we act in accordance with applicable privacy legislation.

Among other things, this means that we:

clearly specify the purposes for which we collect and process personal data. We do so via this privacy statement.

restrict the collection of personal data to those personal data that are needed for the purposes for which the data are processed.

ask for your permission to process your personal data in cases where your permission is required.

do not share your personal data with third parties, unless it is necessary to do so in order to provide the requested service or comply with a legal obligation.

make agreements with parties with whom we share your personal data to ensure they do not use the data for other purposes.

Use of personal data
We collect and use the personal data of applicants, staffing employees, self-employed individuals, interns/graduates and employees.

We collect the personal data you provide to us in order to e.g. conduct an application procedure or close and execute an employment, internship or staffing agreement. Furthermore, we need certain data to comply with and execute provisions from our sector’s collective labour agreement or to comply with certain legal obligations (e.g. paying taxes and premiums on behalf of employees).

The categories of personal data that we may collect from you are the following:

Name and address information

Motivation letter

Resume

Telephone number

Email address

Date of birth

IBAN number

Marital state

Social security number

Gender/nationality

ID/passport

Diplomas

 

If you are an applicant, we will use your personal data to communicate with you about the status of your application procedure. Furthermore, we will use the data to assess your suitability for the position that has or may become available.

If you are a staffing employee, we will use the personal data we receive from the staffing or employment agency to assess your suitability for a vacancy and manage and execute the staffing agreement.

When you begin your employment as an employee, intern/graduate, staffing employee or self-employed individual, we will use your personal data to draw up, execute and terminate the employment, internship, staffing or ZZP agreement. Think of e.g. handling staff affairs, determining and paying out wages, paying taxes and premiums and complying with other fiscal obligations.

 

Sharing data with third parties
We will only share your personal data with third parties if it is necessary to do so for the execution of our agreement. These parties may include government bodies as well as parties who conduct activities on our behalf or parties with whom we are required to share data in light of the execution of the employment agreement.

When we share your personal data with parties who conduct activities on our behalf (e.g. the health and safety service, cloud provider or the payroll processor), we will sign an agreement with the party in question to make sure that, among other things, your data are not used for other purposes. This agreement also stipulates that your personal data must be deleted once they are no longer necessary for the intended purpose.

Data security and retention
We take appropriate security measures to prevent the misuse of and unauthorised access to your personal data. For example, we make sure only essential personnel can access the data, access to the data is restricted and the security measures we have taken are regularly assessed.

We store the personal data of applicants for up to four weeks after the end of the application procedure, unless you give us permission to store your personal data for a period of three years so we can match you with potential future vacancies.

Any personal data from our payroll administration that are of fiscal significance are stored for seven years after the termination of the employment agreement of the employee in question. Payroll tax statements and copies of IDs are stored for five years after the termination of someone’s employment. For other data from our personnel and payroll administration, we utilise retention periods of no more than two years after the termination of someone’s employment. It is sometimes necessary to store data for longer, e.g. to comply with legal obligations or in the event of a labour conflict or lawsuit.

 

Changes to this privacy statement
We may update this privacy statement from time to time. Changes are published on our website. We will never use your personal data for other purposes without your express permission.

It is advisable to consult this privacy statement regularly to ensure you are aware of any changes that may have been made.

 

Access to and rectification of your personal data
You may request access to your own personal data at any time. You may also ask us to complete your personal data or rectify any errors. Furthermore, you can ask us to delete your personal data or restrict the processing of your data.

Of course, you can also object to the collection and processing of your personal data. On the first page of this statement, you’ll find the telephone number, email address and postal address which you can use if you have any questions regarding this privacy statement or our use of your personal data.

As mentioned before, it is of the utmost importance to us that personal data are handled with due care.

If you have any complaints about our data processing and if we cannot resolve the matter together, the Dutch privacy legislation grants you the right to submit a complaint to the Data Protection Authority, the privacy watchdog in the Netherlands.
